May 15, 2006 Charges
When the Saddam Hussein trial reconvened on May 15, 2006, the Presiding Judge, Raouf Abdel-Rahman, issued the Iraqi version of a formal indictment. The Iraqi High Tribunal has provided an electronic version of the Charging Instruments (in Arabic) to Case School of Law for posting on our "Grotian Moment: Saddam Hussein Trial Website," so that they will be available to world-wide viewing by the public and media. English translations will be posted shortly.
According to the Charging Instruments: Saddam is charged with the deaths of nine people who were killed in the first days of the crackdown on the town of Dujail in 1982, the unlawful arrest of 399 townspeople, the torture of women and children, and ordering the razing of farmlands in retaliation for the assassination attempt against Hussein. Contrary to erroneous press reports, Hussein was in fact also charged with the deaths of the 148 who were sentenced to death by his Revolutionary Court.
Saddam's half-brother Barzan Ibrahim, former head of the Mukhabarat intelligence agency, is charged with the same offenses as Saddam, and in addition was charged with murder for the killing of the 148 Shiites sentenced to death by the Revolutionary Court.
Taha Yassin Ramadan, a member of Saddam's ruling Revolutionary Command Council, is charged with the same counts as Barzan Ibrahim, and in addition is charged with overseeing the confiscation and razing of farmlands belonging to Dujail residents.
Co-defendant Awad al-Bandar, the head of the Revolutionary Court, is charged with issuing the death sentences for 148 of the townspeople following a sham trial.
The remaining defendants, Mizhar Abdullah Ruwayyid, Abdullah Kazim Ruwayyid, Ali Dayih and Mohammed Azawi Ali, all lower-level Baath Party officials from Dujail, were charged with informing on Dujail residents who later either died in prison or were sentenced to death.
